These Terms and Conditions (the “Terms”) govern your use of geraldinelustgarten.com (the “Site”) and any purchase you make through it. The Site is operated by GERALDINE (“we”, “us” or “our”). By browsing the Site or placing an order, you agree to these Terms, together with our Shipping & Returns policy and our Privacy Policy. Please read them carefully. If you do not agree, please do not use the Site.

Our online store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.

2. Using the Site

By using the Site, you confirm that you are of legal age in your country of residence, or that you are using it with the consent and supervision of a parent or legal guardian. You agree to use the Site only for lawful purposes. You may not:

• use the Site for any illegal or unauthorized purpose, or in violation of any applicable law;
• infringe our intellectual property rights or those of any third party;
• harass, abuse, defame or discriminate against any person;
• submit false or misleading information;
• upload or transmit viruses or any other malicious code;
• collect or track the personal information of others, or use bots, scrapers or similar tools on the Site;
• interfere with or bypass the security features of the Site.

We may suspend or terminate your access to the Site if you breach these Terms. We reserve the right to refuse service to anyone, at any time, for any lawful reason.

3. Products

We make every effort to display our products, colors and materials as accurately as possible. However, colors may look slightly different depending on your screen, and we cannot guarantee that your display will be completely accurate.

Some products are produced in limited quantities and are available only while supplies last. We may limit the quantity of any product sold per person, household or order, change product descriptions, or discontinue a product at any time.

4. Prices and payment

Prices are shown in Colombian pesos (COP) and may change at any time without notice. The price that applies to your order is the one shown at checkout when you place it.

Payments are processed securely through Mercado Pago. Card details are encrypted during transmission, and we do not store your full card information on our servers.

5. Orders

After you place an order, you will receive an email confirming that we have received it. We reserve the right to refuse or cancel any order, for example if a product is no longer available, if there is an error in the price or description, if we suspect fraud, or if the order appears to have been placed by a reseller or distributor. If we cancel an order that has already been paid, we will notify you using the contact details you provided and issue a full refund to your original payment method.

You agree to provide current, complete and accurate purchase and account information, and to update it promptly if anything changes, so that we can complete your order and contact you when needed.

6. Shipping, returns and your rights as a consumer

Shipping times, returns and refunds are explained in our Shipping & Returns policy, which forms part of these Terms.

If you are a consumer in Colombia, you have the rights granted by the Consumer Protection Statute (Ley 1480 de 2011), including the right of withdrawal for online purchases within 5 business days of delivery, with the exceptions provided by law. Nothing in these Terms limits the rights you have under applicable consumer protection law.

7. Errors and inaccuracies

Occasionally, the Site may contain typographical errors, inaccuracies or omissions in product descriptions, prices, promotions, shipping costs, delivery times or availability. We reserve the right to correct them and to update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after you have submitted your order. In that case, we will refund any amount you have paid.

8. Intellectual property

All content on the Site, including designs, photographs, images, logos, text and graphics, belongs to GERALDINE or is used with permission, and is protected by intellectual property laws. You may not copy, reproduce, sell, resell or otherwise use any part of the Site or its content without our prior written permission.

9. Third-party tools and links

The Site may give you access to third-party tools or links to third-party websites that we do not control. They are provided “as is”, and we are not responsible for their content, accuracy or practices. Please review the terms and policies of any third party before using its services. Any complaints or questions about third-party products or services should be directed to that third party.

10. Comments and submissions

If you send us comments, ideas, suggestions or other materials, whether at our request or not, you agree that we may use, edit, publish and distribute them in any medium, without any obligation to keep them confidential, to compensate you or to respond. You are solely responsible for anything you send us and confirm that it does not violate the rights of any third party or contain unlawful material or malicious code. We may, but are not required to, remove content that we consider unlawful, offensive or otherwise objectionable.

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the rest of the Terms will remain in full force and effect.

These Terms remain in effect until terminated by you or by us. You may terminate them at any time by ceasing to use the Site. We may terminate them, or suspend your access to the Site, without notice if you fail to comply with them. Any obligations incurred before termination will survive it.

16. Entire agreement

These Terms, together with any policies we publish on the Site, constitute the entire agreement between you and us and replace any prior agreements or communications. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms are governed by and interpreted in accordance with the laws of the Republic of Colombia.

Your continued use of the Site after any change means that you accept the updated Terms. The Terms that apply to an order are those in effect at the time the order is placed.
